Trump Asks Supreme Court Permission for State Guard Personnel in the State of Illinois

On the last weekday, the White House petitioned urgently to the US supreme court, seeking approval to deploy military reserve troops to the state of Illinois.

This move is part of a broader campaign to widen the homefront role of the troops in a number of cities run by Democrats.

Legal Battle Over Military Presence

In an immediate request, the US Department of Justice asked the court to overturn a lower court ruling that had halted the sending of hundreds of military reserve members to the greater Chicago.

The district judge had expressed skepticism about the administration's explanation for deploying forces, doubting its rationale in considering local conditions.

A federal appeals court supported the previous order on midweek, maintaining the stationing on hold while the court case moves forward.

Administration's Claims

The top government lawyer, speaking on behalf of the government, stated in the recent request that federal law enforcement have frequently been “threatened and attacked” in Chicago and the suburb of Broadview area.

This location is home to an federal immigration holding center.

The president has earlier dispatched state guard units to Chicago and the city of Portland, following earlier activations to LA, Memphis, Tennessee, and Washington, District of Columbia.

The president has argued that troop deployment is necessary to reduce protests and support deportation efforts.

Ideological Opposition

Democratic officials have pushed back sharply the move, claiming that the president’s claims are inflated and driven by politics.

They charge the president of exploiting his executive power to punish opponents.

At the heart of the dispute is the administration's application of a federal statute permitting the president to nationalize the national guard only in cases of uprising or when “unable with the federal troops to enforce the laws of the US”.

The administration insists that the troops are required to safeguard US facilities and personnel from activists.

Earlier this month, the government took control of 300 members of the Illinois military reserve and ordered more Texas national guard forces into the state.

As state authorities denounced the decision, the White House escalated his rhetoric, calling on the detention of Chicago’s mayor and the Illinois governor, the two Democratic officials, charging them of neglecting to safeguard immigration officers.

Illinois and the city of Chicago jointly sued the administration to block the activation.

On the ninth of October, district Judge April Perry, a Biden appointee, delivered a preliminary order preventing the command.

At the same time in Chicago, at least a dozen people were detained outside the federal detention center following heated confrontations between Illinois state police and demonstrators.
